Optimum Theme grants you a revocable, non-transferable and non-exclusive license to use products sold on the Optimum Theme website in accordance with the following terms and conditions.
1- Product Licensing and Usage
will be provided only to members who purchased a monthly membership
plan. Members who purchase single-template have to register on our site and they have access to our Community Forum
but there is no response guarantee on Community Forum. As the name states it clearly, it's a Community based forum that users can share their knowledge and help each other.
Optimum Theme Support staff provides official support to only club members (who paid for a monthly plan) via our Ticket System.
Optimum Theme and its support staff provides support only for Optimum Theme products, there is no support for issues not related to our products or services. Support providing channels are; documentation, tutorials, support forum and the Ticket System (official).
For the questions and queries about 3rd party extensions you can contact with the respective developers. For Joomla CMS and Joomla core support you can visit official Joomla forums (forum.joomla.org) or any other support channels like local Joomla support sites, JUG etc.
Optimum Theme will not provide support by any other means including, but not limited to, email, regular mail, telephone, Twitter, Facebook, Skype etc.
Our support hours Monday to Friday, from 10.00 to 17.00 (GMT+2) but not limited. Support Staff will do the best to provide support within 24 hours.
Please note that there is a difference between “technical support” and “customization”. Optimum Theme committed to provide you support with any type of query, however Optimum Theme can't provide extensive help, customization and support in terms of “customizations”.
Subscription at Optimum Theme is not to be considered as a gurantee of response time or a service level agreement. All support questions and tickets are answered on a "best effort" basis. Optimum Theme reserves the right to decline support if the request or the conversation is conducted in a language other than English or when the language barrier makes it impossible to provide meaningful support.
Optimum Theme reserves the right to provide no support for outdated versions of its software or when customers’ server environment does not meet its products’ minimum requirements.
Optimum Theme reserves the right to close and/or lock support tickets for any reason deemed appropriate.
Optimum Theme commits to provide support only for current and applicable Joomla CMS stable versions. Products for non-stable and older versions will not be supported.
3- Refund Policy
Optimum Theme does not provide refunds to digital goods sold through OptimumTheme.com. But we provide demo section to site visitors to check the demos and see if our products meets with their expectations and needs. Please contact us for further informations about our products if you are not sure that whether they meet your expectations.
Optimum Theme gives no warranty or guarantee for themes and other products in any manner. Browser compatibility should be tested viewing the themes and products on demo sites. Please ensure that your browser works with the theme design. We cannot give you the guarantee that the products will work with all third party extensions. Please be aware of that. We guarantee that our themes work with the current version of Joomla CMS. We cannot guarantee though that they will work with future versions of Joomla. Also, Optimum Theme products will always be produced for the latest stable Joomla version.
Our services are provided as-is, without any warranty whatsoever. The exact terms of our software license can be read by above the "License Policy" part. Regarding the support services, we can not guarantee the validity or veracity of any provided information or suggestion.
THE SERVICES ARE PROVIDED AS-IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE AVAILABILITY, QUALITY AND PERFORMANCE OF OUR SERVICES IS WITH YOU. SHOULD ANY OF OUR SERVICES PROVE INEFFICIENT OR UNSUITABLE, YOU ASSUME THE COST OF ALL NECESSARY ACTIONS TO RECTIFY THE ISSUE.
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OPTIMUM THEME, ITS OWNERS, STAFF, ASSOCIATES OR ANYONE AFFILIATED WITH ITS MAINTENANCE, OPERATION OR HOSTING BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF OUR PROGRAMS TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Should the applicable law hold Optimum Theme, its owners or any party affiliated with it liable for damages, the maximum amount of damages acknowledged shall be no higher than 5 Euro. Shall any dispute arise between the owners of Optimum Theme and a third party, the only applicable jurisdiction is the Courts of Law of the Istanbul Anadolu Adalet Sarayı, Turkey.
If you do not agree with these Terms, you are not allowed to use our services. Moreover, any use of our services implies the unconditional and immediate acceptance of the aforementioned terms, waiving your legal rights to uphold them. Acting in violation of these Terms of Service constitutes a violation of our copyright and abuse of a computer system, both persecutable as felonies.
You may not claim intellectual or exclusive ownership to any of our products, or parts thereof, modified or unmodified. All products of Optimum Theme remain the property of independent content providers. Our products are provided “as-is” without warranty of any kind, either expressed or implied. In no event shall Optimum Theme be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Product (theme and extension) updates are available during membership period to customers who have active membership (customers who made an individual -pay & download- theme/extension purchase have 12 months access to update). They are also available for all the themes accessible by our club members whilst their club subscription is still active.
All themes are always designed to be compatible with the latest available version of Joomla, but we can give no guarantee, that older themes will run with future versions of Joomla. We are however committed to doing our best to make all the themes compatible with future releases of Joomla as quickly as we can.
7- 3rd Party Extension Compatibility
Sometimes we use 3rd party commercial (paid) or non-commercial (free) extensions and apps on our templates with custom styles or layouts. At the time of developing we use the latest version(s) of the extension(s). But we do not guarantee that these themes and their custom stylings & layouts will run with future versions of those extensions.
After we have successfully received your payment, your Optimum Theme membership information will be emailed to the email address you provided on registration. This may take up to 1 hour but usually happens within minutes. If you do not receive an email after this time period, contact us through this website. Upon logging in with the provided credentials, Optimum Theme members will have instant access to all products and other premium contents accordance with their subscriptions. After membership has expired, download access and Ticket System access are removed, entitlement rights continue however.
Pay & Download customers (individual purchase) have right to download products for in 1 year time period.
9- Price Changes and Updates
Optimum Theme reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a subscription (or any part thereof) with or without notice. Prices of all memberships and products, including but not limited to monthly subscription plan fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Optimum Theme website.
Any information submitted by the buyer/customer will be used solely for the purpose of completing the transaction, delivering the product, informing about new product releases, informing about partners' product promotions with our memberships and addressing any customer service issues.

In other words, These files are not released under the GPL, and are supplied to each paying user for personal use only. You may not offer them, modified or unmodified, for redistribution or resale of any kind or include them in a package or extension of your own without prior consent of Optimum Theme
